President's order aims to keep meat
and poultry plants open

resident Donald Trump on April 28 invoked the Defense Production Act of 1950 in issuing an executive order directing
Secretary of Agriculture Sonny Perdue to take all appropriate
action "to ensure meat and poultry processors continue operations
consistent with the guidance for their operations jointly issued
by the Centers for Disease Control and Prevention (CDC) and the
Occupational Safety and Health Administration (OSHA)."
The order stated, "It is important that processors of beef, pork
and poultry in the food supply chain continue operating and fulfilling orders to ensure a continued supply of protein for Americans."
The order noted outbreaks of COVID-19 among workers at
several meat processing facilities have led to the reduction in
many of those facilities' production capacity or even in their closing, sometimes at the behest of state or local health authorities.
The order indicated the interim guidance, titled "Meat and
poultry processing workers and employers" and issued on April
26 by the CDC and OSHA, will provide for the safe operation of
such facilities allowing those that were closed to reopen and
those in operation through the pandemic to date to remain open.
The guidance said processing plants should create COVID-19
assessment and control plans to identify risks and prevention strategies, and that as part of the assessments, facilities should consider
the appropriate role for testing and workplace contact tracing.
Given the CDC-OSHA document is a guidance and not a
directive, several suggestions are qualified. For instance, the
guidance says plant management should "configure communal
work environments so workers are spaced at least six feet apart,
if possible" or "modify the alignment of workstations, including
along processing lines, if feasible."
The guidance includes a section on cloth face coverings as
a protective measure but did not comment on whether personal
protective equipment, such as N95 respirators or medical facemasks, should be provided to workers. The guidance also states,
"Screening meat and poultry processing workers for COVID-19
symptoms (such as temperature checks) is an optional strategy
that employers may use." The guidance then provides instructions on how to screen workers if employers decide to do so.
Mr. Perdue said the US Department of Agriculture will work
with meat processing companies to ensure they operate in accordance with the CDC and OSHA guidance, and then work with state
and local officials to ensure the plants are allowed to operate.
The North American Meat Institute approved of the president's executive order. Julie Anna Potts, president of the NAMI,
said the order will help avert hardship for agricultural producers

Ensuring workers' safety
while keeping meat shelves
stocked is the challenge

and keep safe, affordable food on the tables of American families
even as it protects the safety of the meat processing workforce.
The Acheson Group, which advises the food industry on health
and safety concerns, in a recent blog stated, "While it is important
to protect the meat supply chain, it is critical that processors strike a
balance between continuing food production and protecting worker
health. Employees are your greatest asset, and if businesses highlight
staying open ahead of employees' health, they may soon find that
they will not have a workforce left to produce the food."
The Acheson Group said if meat and poultry processors continue operations consistent with the guidance issued by the CDC
and OSHA, "there appears to be the flexibility for businesses and
processors to use their best judgment for striking the right balance,
thus protecting both workers and the meat and poultry supply."
Labor and congressional Democrats, though, sought greater
safeguards for workers' health and safety.
Marc Perrone, president of the United Food and Commercial
Workers Union, said, "We urge the administration to immediately enact clear and enforceable safety standards that compel all
meatpacking companies to provide the highest level of protective
equipment through access to the federal stockpile of PPE, ensure
daily testing is available for workers and their communities, enforce physical distancing at all plants, and provide full paid sick
leave for any workers who are infected."
In a May 1 letter to Mr. Perdue; Alex M. Azar, secretary of the
Department of Health and Human Services; and Eugene Scalia,
secretary of the Department of Labor; 48 Democratic members
of the House of Representatives complained that neither the
executive order nor the subsequent USDA press release "contain
information about coordination between federal agencies to
provide PPE or plans to increase coronavirus testing for plant
employees and the surrounding communities."
The House members posed eight questions about topics
including the plan and timeline for distributing PPE to all plant
employees, whether companies will be required to retrofit plants
and/or modify shifts and other practices to minimize risk of
spreading COVID-19, and whether increased testing for symptomatic and asymptomatic employees will be put in place. FBN
